Ferris Tae Kwon Do will use its best efforts to assist the student in the obtaining his or her maximum potential in the Martial Arts. Ferris Tae Kwon Do is committed to providing and maintaining competent instructors, suitable facilities, and a varied and regular class schedule. I recognize that class schedules may be adjusted periodically to further Ferris Tae Kwon Do’s goal of matching students of generally similar size and ability. I recognize that leadership training is an integral part of the discipline of the Martial Arts, and that therefore students at higher belt levels may occasionally assist Ferris Tae Kwon Do instructors in providing instruction and supervision in classes. Official belt recognition will be issued to the Student by Ferris Tae Kwon Do upon successful completion of any examination and the requirements thereof.
Being a member of Ferris Tae Kwon Do, I will faithfully comply with all the rules of Ferris Tae Kwon Do and the traditions of the Martial Arts. I recognize that regular class attendance is important for my progress and I understand that is my responsibility to attend the classes. The Student, parent or legal guardian of the Student, acknowledges that there have been no representations, promises, or inducements made by Ferris Tae Kwon Do with respect to this agreement, other than expressly set for herein, and that this agreement contains the entire understanding between the parties. I further understand that failure to attend classes does not relieve me of my obligation to pay the tuition in full. I recognize that Ferris Tae Kwon Do has made a substantial commitment in terms of staff and facilities in order to provide competent levels of instruction in the Martial Arts, and therefore acknowledge a corresponding commitment on my part to fulfill my obligations under this agreement. These obligations include payment of the tuition set forth on the other side of this agreement.
The Student, parent or legal guardian on behalf of the Student, acknowledges and is fully cognizant of all the inherent dangers in connection with execution of Martials arts and acknowledges that the execution of the Martial Arts requires physical exertion and contact, and realizes that there is risk of physical injury which may be incurred while engaging in this activity. Protective equipment, required by Ferris Tae Kwon Do, will largely eliminate the possibility of injury, however, Ferris Tae Kwon Do does not warrant the protective equipment. It is always the student’s responsibility to purchase such equipment and to wear it at all times.
In consideration of being allowed to enroll in the course, the Student, parent or legal guardian on behalf of the Student, hereby personally assumes all risks of bodily injury, death or property damage due to the negligence of Ferris Tae Kwon Do, its principals, agents, employees, and instructors, fellow students, or others in connection with the activities undertaken in the teaching, practices, training, testing, and competition involving Martial Arts; and further for him/herself, his/her spouse, legal representatives, heirs and assigns, hereby releases, waives, discharges and agrees to save and hold harmless Ferris Tae Kwon Do, its principals, agents, employees, instructors and fellow students, for any injury or damage whether foreseen or unforeseen, any claim resulting therefrom whether caused by the negligence of Ferris Tae Kwon Do, its principals, agents, employees, instructors and fellow students arising out of the enrollment or participation of this course.
The Student, parent or legal guardian of the Student further states that (s)he is of lawful age and is legally competent to sign this agreement and release, and understands that the terms herein are contractual and not a mere recital, and has signed this document as his/her own free act.
The Student, parent or legal guardian of the Student warrants that the student has had a medical examination to assure him/herself, and assume his/her own responsibility of physical fitness and capacity to perform under this program, and is physically fit as attested to by the medical examination.
The Student has an option to cancel this agreement within 72 hours of execution of this agreement and obtain a refund of first month’s payment less 25% of the received first month’s payment.
This agreement is not transferable without express written consent of Ferris Tae Kwon Do.
Photographs and Video Consent, Waiver, Indemnity and Release:
I hereby waive any right to inspect or approve the use of the images or recordings or of any written copy. I further waive all moral rights. I also waive any right to royalties or other compensation arising from or related to the use of the images, recordings or materials. I hereby release, defend, indemnify and hold harmless Ferris, Tae Kwon Do and there representatives from and against any claims, damages or liability arising from or related to the use of the images, recordings or materials, including by not limited to claims of defamation, invasion of privacy, or rights of publicity or copyright infringement, or any misuse, distortion, blurring, alteration, optical illusion or use in composite form that may occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution. I the student, parent or legal guardian of the student further states that (s)he is of lawful age and is legally competent to sign this waiver in the name of the student(s). I have read this document before signing below, and I fully understand the contents, meaning and impact of this consent, waiver, indemnity, and release. This consent, waiver, indemnity and release is binding on me, my heirs, executors, administrator and assigns.
COVID-19 Waiver of Liability and hold harmless:
In consideration for receiving permission to BE ON PREMISES at Ferris Tae Kwon Do (hereinafter the “Activity or Activities”), I, on behalf of myself and any minor child/children for whom I have the capacity to contract, hereby acknowledge and agree to the following:
- I understand the hazards of the novel coronavirus (“COVID-19”) and am familiar with the Centers for Disease Control and Prevention (“CDC”) guidelines regarding COVID-19. I acknowledge and understand that the circumstances regarding COVID-19 are changing from day to day and that, accordingly, the CDC guidelines are regularly modified and updated and I accept full responsibility for familiarizing myself with the most recent updates.
- Notwithstanding the risks associated with COVID-19, which I readily acknowledge, I hereby willingly choose to participate in Activities.
- I acknowledge and fully assume the risk of illness or death related to COVID-19 arising from my being on the premises and participating in the Activities and hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE (on behalf of myself and any minor children form whom I have the capacity contract) Ferris Tae Kwon Do, their owners, officers, directors, agents, employees and assigns (the “RELEASEES”) from any liability related to COVID-19 which might occur as a result my being on the premises and participating in the Activities.
- I shall indemnify, defend and hold harmless the RELEASEES from and against any and all claims, demands, suits, judgments, losses or expenses of any nature whatsoever (including, without limitation, attorneys’ fees, costs and disbursements, whether of in-house or outside counsel and whether or not an action is brought, on appeal or otherwise), arising from or out of, or relating to, directly or indirectly, the infection of COVID-19 or any other illness or injury.
- It is my express intent that this Waiver and Hold Harmless Agreement shall bind any assigns and representatives, and shall be deemed as a RELEASE, WAIVER, DISCHARGE, AND COVENANT NOT TO SUE the above-named RELEASEES. This Agreement and the provisions contained herein shall be construed, interpreted and controlled according to the laws of the State of Texas. I HEREBY KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A JURY TRIAL OF ANY DISPUTE ARISING IN CONNECTION WITH THIS AGREEMENT. I ACKNOWLEDGE THAT THIS WAIVER WAS EXPRESSLY NEGOTIATED AND IS A MATERIAL INDUCEMENT THE PERMISSION GRANTED BY RELEASEES TO BE ON PREMISES AND PARTICIPATE IN THE ACTIVITIES.
IN SIGNING THIS AGREEMENT, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Wavier of Liability and Hold Harmless Agreement, understand it and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Agreement for full, adequate and complete consideration fully intending to be bound by same.
THE student, OR PARENT OR LEGAL GUARDIAN OF THE STUDENT, ACKNOWLEDGES THAT HE/SHE HAS FULLY INFORMED HIMESELF/HERSELF OF THE CONTENTS OF ALL SIDES OF THIS AGREEMENT AND RELEASE BY READING IT BEFORE SIGNING IT.
